Bryan Loeffler is a Partner with the firm and is a Registered U.S. Patent Attorney who concentrates his practice in patent law and all other areas of intellectual property law, including trademarks/servicemarks, trade dress, trade secrets, copyrights and litigation. Bryan is Board Certified as an expert in Intellectual Property Law by The Florida Bar.

Bryan graduated from The University of Massachusetts with a Bachelor of Science and received his legal education at Nova Southeastern University where he graduated with honors. Prior to joining Livingston Loeffler, Bryan gained courtroom and trial experience working at the Public Defender’s Office for the 20th Judicial Circuit of Florida.

Bryan has an educational background in biology and chemistry as well as business administration. Bryan also has extensive experience preparing and prosecuting patent applications covering complex mechanical and electrical devices as well as computer software, mobile applications and related business methods. In addition, Bryan’s business background allows him to advise entrepreneurs with new or existing businesses on protecting their ideas and concepts as well on avoiding liability from possible infringement of others.

As an Eagle Scout, Bryan has always been involved in the community with his work as a former volunteer firefighter and emergency medical technician and his current work with various charities throughout Southwest Florida.

PRACTICE AREAS

Patents: Bryan is experienced in all aspects of patent prosecution including performing patentability searches and rendering opinions as to the availability of patent protection for an invention, preparing and filing patent applications as well as prosecuting patent applications before the United States Patent and Trademark Office. Bryan also negotiates and prepares patent licensing agreements and renders legal opinions regarding patent infringement and patent validity. Some of the areas Bryan has prepared and prosecuted patent applications include, but are not limited to, telecommunications, power saving devices, fuel efficiency devices, arts and crafts, boating, fishing, golfing, plants, construction, computer software, medical devices, diesel mechanics, environmental clean-up and business methods. Bryan also has extensive experience working with foreign co-counsel around the world to procure and enforce foreign patent rights utilizing the Patent Cooperation Treaty (PCT) and other available foreign patent laws to obtain foreign patents.

Licensing & Marketing – Bryan assists clients beyond the patent process by helping clients get their ideas and products to the marketplace and on the store shelf. That may be by submitting a client’s idea to companies for licensing and negotiating licenses on the client’s behalf or by assisting clients in dealing with third parties, such as manufacturers, engineers, designers and website developers, to ensure that the client is protected every step of the way.

Trademarks/Servicemarks Bryan is experienced in all aspects of the trademarking/servicemark process including performing trademark/servicemark searches and rendering opinions with regard to the availability of a trademark/servicemark as well as filing and prosecuting federal, State of Florida , and international trademark/servicemark applications. In addition, Bryan negotiates and prepares trademark/servicemark licenses on behalf of his clients.

Copyrights Bryan has prepared and filed copyright applications for his clients in a variety of areas including building designs, artwork, manuscripts, websites, artwork, jewelry, musical works, movies, and computer software and is well versed in the laws regarding copyright infringement. Bryan is also experienced in negotiating copyright licenses.

Trade Secrets Bryan is able to advise his clients how to protect trade secrets, which include client lists, formulas, devices, and other sensitive information, all of which is confidential and not generally known to the public or is not subject to protection under patent law.

Intellectual Property Litigation Bryan is available to assist his clients in all aspects of intellectual property litigation.
