Filing for Foreign Patent Protection under the Patent Cooperation Treaty

Livingston Law’s patent attorneys can obtain foreign patent protection for you under the Patent Cooperation Treaty (“PCT”). The PCT is an international treaty that allows an inventor to obtain a patent pending in 148 foreign countries using a single filing. The PCT delays the expenses associated with applying for patent protection in foreign countries for up to thirty or thirty-one months (depending on the country), thereby allowing the inventor more time to assess the commercial viability of his or her invention. At the end of the thirty or thirty-one month period we can assist you with choosing which countries you want to pursue patent protection in and then work with our foreign co-counsel to obtain patent protection in those countries.

Patent Prosecution Highway

Under the Patent Prosecution Highway (“PPH”), an applicant receiving a ruling from a foreign patent office that at least one claim in a patent application is patentable may request that the United States Patent and Trademark Office (“USPTO”) to fast track the examination of corresponding applications filed in the USPTO. The PPH allows applicants to obtain corresponding patents faster and more efficiently.
